Contemporary Operational Environment
- The 7th of October 2023 terrorist attack on Israel in which unidentified terrorists physically entered Israel, having no resistance from Israel Defence Forces (IDF) or other Israel security agencies, carried out a number of killings, caused injuries and abductions. Israel blamed Hamas and next day to take revenge IDF carried out intensive aerial bombardments on Gaza, followed by physical intrusion by IDF inside Gaza. Today, after almost after two years there is continuous Israel and her allies’ bombardments inside Gaza, where hundreds of buildings have been razed to ground and thousands of men, women and children become the prey of Israeli genocide. Many children as orphans and otherwise have been abducted and transferred in foreign countries.
- As the result of above Israeli war crimes and genocide of unarmed Muslim Palestinians, the International Court of Justice (ICC) on 21 November 2024 issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant under article 58 of the Rome Statute citing allegations of war crimes and crimes against humanity. Arrest warrants of former Hamas commanders; Ismail Haniyeh, Yahya Sinwar and Mohammed Diab Ibrahim were also issued. IDF killed all the Palestinian commanders against whom arrest warrants were issued while alleged Israeli war criminals are at large.
- Meanwhile, the world strongly condemned Israeli genocide of Palestinian Muslims and whole hearted funding and arming by United States while the movement for the Independent of Palestine bore fruit and a core document “New York Declaration on Palestine” was endorsed by the United Nations General Assembly on 12 September 2025, which is pending for its implementation in letter and spirit under the Co-Chairs Saudi Arabia and France nominated in the same document. Other Co-Chairs of Working Groups and nations will assist Saudi Arabia and France to ensure durable peace between Palestine and Israel.
- On 22 September 2025, a number of new countries announced recognition of Palestinian state at UN General Assembly, increasing the total number of countries, which recognized Palestine as a sovereign state to 156 out of total 193 member states of the United Nations. These countries have also nominated their diplomats for the Palestinian state and also allowed to establish their Embassies in their countries.
Tasks before Co-Chairs Saudi Arabia and France as the Implementation Authority
- Now the responsibility rests on Saudi Arabia and France as Co-Chairs to lead the implementation phase for durable peace between State of Israel and the State of Palestine. Serial 41 of The New York Declaration entrusts the co-Chairs of both the conference and the working groups, including in the context of the Global Alliance for the implementation of the two-State solution, to serve as an international mechanism for the follow-up of the objectives of Conference and the commitments made therein. Accordingly, the immediate actions and short term implementation actions will be taken care by Saudi Arabia and France which medium and long term measures will be implemented at next Phase by Co-Chairs and Co-Chairs of Working Groups.
- Following are Immediate Actions tasks before the Implementation Authority:-
- Facilitate complete withdrawal of Israeli forces from Gaza subject to the Israeli full withdrawal over release of all hostages, the exchange of Palestinian prisoners, the return of all remains.
- Withdrawal of Israeli forces would effect immediately, however, subject to negotiations with Implementation Authority the Israeli Advisors or representatives along with required Israeli armed security contingent sufficient to provide security to Advisors will remain in Gaza till the release of all hostages, the exchange of Palestinian prisoners, the return of all remains is not effected.
- Facilitate mechanism with the assistance of Palestinian Authority for the formulation of Palestinian Interim working Constitution and Interim Administration through chosen Palestinian leadership where Palestinian system of governance would be democratic on the basis of Islamic principles ensuring both nations living side by side, in peace and tranquility, enabling full regional integration and mutual recognition of territories.
- Ensure safe, unconditional and unhindered delivery of humanitarian assistance through all crossings and throughout the Gaza Strip, in coordination with the UN and ICRC and in line with humanitarian principles.
- The Interim administration in Gaza and Israeli withdrawing Forces will ensure pre 7th October 2023, opening of border crossings, resumption of power supplies and the entry of fuel, medical supplies, food, water and other essential supplies.
- Saudi Arabia and France with the assistance of other UN members will provide protection of UN and humanitarian workers including UNWRA to operate effectively in Gaza.
- UNRWA will continue its role and obligations through the appropriate funding and the implementation of its mandate including recommendations of the Colonna report.
- Following are Short Term Actions before the Implementation Authority:-
- Palestinian State would comprise of territories including West Bank and Gaza with Jerusalem as capital. All Palestinian territories will be unified with no occupation, siege, territorial reduction, or forced displacement.
- As an interim arrangement Palestinian Authority has been solely empowered with Governance, law enforcement and security across all Palestinian territory. Hamas rule in Gaza will end and handing over control of Gaza including its weapons to the Palestinian Authority through Implementation Authority will be encouraged to take place voluntarily. However, if difficulty arises Disarmament Demobilization and Reintegration (DDR) will be done through international engagement and support. The process will be completed within an agreed mechanism with international partners and a set timeframe.
- Implementation of the Arab-OIC reconstruction plan for the early recovery and reconstruction in the Gaza Strip will take place with due participation of all states and regional and international partners by creating Palestine Recovery and Reconstruction Fund (PRRF). Utilization of funds will be carried out with due consideration to transparency and accountability mechanism and international best practice on acquisition and tendering. A conference in the same regard will be held in Cairo.
- Ceasefire will be effected after release of all hostages, the exchange of Palestinian prisoners, the return of all remains after due negotiations with Implementation Authority. This will be followed by setting up of a democratically elected transitional administrative committee to operate in Gaza / Palestinian territories under the umbrella of the Palestinian Authority. The Committee will pave way for framing holding of general elections and formulation of Constitution of Palestine.
- Member States, the United Nations, its agencies, international organizations will provide resources and assistance at scale to support recovery and reconstruction in the dedicated Reconstruction International Trust Fund (May also be named as Palestine Recovery and Reconstruction Fund).
- f For the purpose of humanitarian aid only, Palestinian Authority/ transitional administrative committee may requisite deployment of a temporary International Stabilization Mission under the aegis of the UN and in line with UN principles. Member states especially regional countries may contribute in troops and extend support for monitoring of humanitarian aid.
- Palestinian refugees would be dealt under UNGA Resolution 194. In the first Phase the orphan children or those smuggled by other nations and kept at orphan houses and residence will return to Palestine. In second stage those who were forcibly evicted after 7 October 2025 will be approached and subsequently other parts of the Resolution will be implemented.
- UNRWA will continue its role and obligations, however, once democratic elections are held and chosen representatives of the Palestinian nation are elected UNRWA will hand over its public-like services in the Palestinian territory to empowered and prepared Palestinian institutions.
- Once the above Immediate and Short Term objectives are achieved, Implementation Authority may submit report to UN for moving to next phase of The New York Declaration.
