The Hegemonic Designs of India

Since the independence from British rule consistent efforts with Mala-fide intentions are being meted out by the Indian leadership to make the status of Kashmir controversial by Indian government which, is still an unfinished agenda and litmus test for the international organizations like United Nations to solve it and raises a big question for the its credibility . Kashmir is a Himalayan region having a significant strategic importance to both India and Pakistan which say it is fully theirs. The area was once a princely state called Jammu and Kashmir. India and Pakistan subsequently went to war over it and each came to control different parts of the territory with a ceasefire line agreed. There has been pro violence situation in the Indian-administered side - the state of Jammu, and Kashmir - for 30 years due to a freedom movement against tyrannical Indian rule and this have taken thousands of precious lives of innocent Kashmiris along ransacking home , illegal detention etc .

The most ugliest and cruel thing that happened by the incumbent extremist government of India on 5th August 2019 was abolishing of the article 35- A that was a footed in Kashmir. Thousands of additional Indian troops were deployed, a major Hindu pilgrimage was cancelled, schools and colleges were closed, visitors were ordered to leave and all kinds of communication source were cut down including telephone, internet services were suspended in order to hide facts from international community. Moreover, regional political leaders were retained under house arrest fearing gross root-level resentment, protestation and street agitation by them due to scrapping and abrogation of Article 35A of the Indian constitution, which gave some special privileges to the people of the state. The government had taken aback everyone by revoking nearly all of Article 370, which 35A is part of to implement their hegemonic designs in the area and which has been the basis of Kashmir's complex relationship with India since independence.

The significance of Article 370 valued highly because the article allowed the state to run a firm extent of autonomy - its own constitution, a separate flag and choice to make laws. While the Foreign affairs, defense and communications were remain at the hand of the central government. As a consequence, Jammu and Kashmir assembly could pass its own laws relating to the affairs of Kashmiri people regarding citizenship, ownership of property and fundamental rights. It could also bar Indians from outside the state from purchasing property or settling there. Then modified the central laws by Parliament to Jammu and Kashmir and altered the current state laws by substituting “state of J&K” with the Union Territory of J&K by Union home ministry of India on Monday, Oct 06, 2020 to further aggravate the situation and manipulate the right of Kashmiris people in illegally Indian occupied Jammu Kashmir.

These draconian actions on Kashmir are controversial in manifolds giving the sense that current controversial law amendments has further snatched the fundamental rights from the Kashmiri people brutally, given to them in Indian constitution earlier. Many Kashmiris believe that the BJP eventually desires to change the demographic shape of the Muslim-majority region by allowing non-Kashmiris to buy land there to convert the Muslims of Jammu and Kashmir into minority. It is radical change on the ground because Kashmir will no longer have a separate constitution but will have to bear by the Indian constitution much like any other state. All Indian laws will be mechanically applicable to Kashmiris, and people from outside the state will be able to buy property there.

The government is further moving to boost up its nefarious designs to spill up the state into two smaller, federally administered territories. One region will combine Muslim-majority Kashmir and Hindu-majority Jammu. The other is Buddhist-majority Ladakh, which is culturally and historically near to Tibet.

This “catastrophic footstep" is fuelling add to injury as according to the constitution, Article 370 could only be altered with the settlement of the "state government" of Jammu and Kashmir but there is no state government in Jammu and Kashmir for over a year during the imposition of the black laws .

The government said it was well within its rights to bring in the changes and that similar decisions have been taken by federal governments in the past but expert opinion is sharply criticized the decision. However according to many Indian constitutional experts, it was "an illegal decision, akin to committing fraud" that could be challenged in the Supreme Court. The Kashmiri leadership said the decision betrayed Kashmir's decision to align with India in 1947. Ms Mufti the ex- chief minister of Jammu and Kashmir , went on to speak to an exclusive interview for the BBC I which she said "we the people who had faith in the constitution of India have been proved wrong.” We have been let down by the same nation we ceded to," she said, adding that it seemed as though the state had made the "wrong choice" in aligning with India rather than Pakistan during partition in 1947.

Keeping in view the whole scenario, such things are sharply running towards a war like situation between the two nuclear hostile neighbors of south East Asia if, not averted wisely. In this respect the responsibility of United Nations and international community become increase including United States and United Kingdom to interfere and solve this problem according to UN resolutions as they did it in Kosovo and Bosnia.
